Do you own or occupy a building? If so, you are responsible for fire safety and fire prevention. For this there are national rules laid down in Chapter 6 of the Building Works Decree living environment.

You must file a notification.

How does it work?

After January 1, 2024, you cannot submit a new application for Omgevingsvergunning for fire-safe use. Only a use notification fire-safe use will still exist. 

It is prohibited to use a structure without notifying this at least 4 weeks before the start of the use of the structure. The use notification is mandatory if more persons are present in the structure than indicated in Table 6.6 Building Works Decree living environment.

Report

You make the notification through the Digital System for the Environment Act (DSO).

Enclose with your fire safe use notification

  • The name and address of the person performing the activity and, if applicable
    , of the person authorized to report.
  • The date.
  • The address, cadastral designation or location of the structure.
  • A site sketch with north arrow to a scale no smaller than 1:1,000 + a floor plan drawing per building level to a scale no smaller than 1:100 for a building with a gross floor area of less than 10,000 m² and no smaller than 1:200 for a larger gross floor area. 
  • The plan drawing or an appendix thereto indicates:
    1. Scale indication. 
    2. Per floor level: height of floor above measurement level, use area, maximum number of persons.
    3. Per space:
      • Floor area.
      • Use Function.
      • For rooms for more than 25 people, the highest occupancy of that room.
      • Establishment of inventory and furnishing elements referred to in this decision.
    4. With indications of the location of, if any:
      1. Fire and/or smoke resistant partition structures.
      2. Escape routes.
      3. Direction of rotation of doors referred to in Article 3.121.
      4. Self-closing doors referred to in Article 3.123.
      5. Door locks referred to in Articles 3.122 and 6.21.
      6. Escape route signs.
      7. Emergency Lighting
      8. Orientation lighting referred to in Article 3.103.
      9. Fire alarm control panel and fire alarm panel.
      10. Fire hose reels.
      11. Mobile fire extinguishers.
      12. Dry fire lines.
      13. Firemen's entrance.
      14. Key safe or tube.
      15. Fireman's elevator.
    5. The nature and location of fire safety installations. The indications are in accordance with NEN 1413 to the extent provided for in this standard. 
    6. When applying an equivalent measure to the rules in Section 6.2 and Section 6.5.1: data and documents demonstrating equivalence.

In a use notification for temporary or seasonal use of a structure, the person performing the activity referred to in Article 6.1 shall indicate the period or periods of time in a calendar year for which the use is intended.

A use notification may relate to multiple structures on the same property or on related properties.

Making a report is free of charge. 

How long will it take?

You must submit the notification with attachments at least 4 weeks before using the building.
