Holding municipality liable

If you are damaged or injured and it is the fault of the municipality, you can hold the municipality liable. You do this by filing a claim for damages with the municipality.

How does it work?

The municipality assesses your claim for damages. If the municipality also finds that it is liable, you will be compensated for the damage (or part of it).

What to do?

Note! Was the damage caused by a company performing work for or on behalf of the municipality? Then send the claim to that company and not to the municipality.

You are insured?

If you are insured, report the damage to your insurer. They will arrange it further with the municipality.

You are not insured?

You send the claim to the municipality as soon as possible after the event:

Are you sending the claim by mail? Then put the following information in your claim:

  • Description of the event (with place, date and time).
  • Why you are holding the municipality liable.
  • Description and evidence (e.g., photographs) of the damage.
  • Photos of the spot, the area and what caused the damage.
  • The damage amount (with paid invoices as proof).
  • Names of specialists who reviewed your claim.
  • Your name, address, (mobile) phone number and e-mail address.
  • The account number (IBAN), with the corresponding initials and last name, to which any compensation can be deposited.
  • Any statement(s) from witness(es).
How long will it take?
  • You will receive confirmation of receipt within 5 business days.
  • We use service standards for handling mail.
  • The handling time varies for each claim/liability due to investigations that must be conducted.
  • The municipality may ask you for additional information. You will be notified of this within 2 weeks.
  • If your request is recognized, you may receive compensation or partial compensation.
  • If your request is denied, you will receive a letter of explanation.
