The full name of the Bibob Act is "The Promotion of Integrity Assessments by Public Administration Act. Based on this law, the municipality investigates whether the applicant for certain permits or subsidies is trustworthy. If there is a danger that this permit will be used to commit criminal offenses, or it is suspected that criminal offenses have been committed, the municipality will not issue the permit or can revoke an existing permit.

What do you need to know?

In a Bibob investigation, the municipality looks at:

  • Financing the business.
  • The background of the permit applicant.

For the investigation, the municipality primarily uses public sources. If in doubt, the municipality can ask the National Bibob Bureau (LBB) for advice.

In what cases?

For the items listed below, you must complete the Bibob Questionnaire. Without this form, we will not process your application for a permit or grant. Do you already have a permit and refuse to provide additional information? Then the municipality may revoke your permit.

Alcohol License

A license for a catering establishment under Section 3 of the Alcohol Act. See also: alcohol license.

Operating license

A permit for a catering establishment pursuant to article 2:15a of the APV. See also: Horeca Establishment Operating Permit.

Sex business license

A license for a sex business and/or escort business under article 3:4 of the APV. See also: Starting a sex business.

Martial arts gala

An event permit for a martial arts gala under Article 2:13 of the APV. See also: organizing an event.

Environmental Permit

An environmental permit for a construction activity in the following cases:

  • When construction costs exceed €500,000.
  • Car dealership, garages, leasing companies, tire business and scrap metal trade.
  • Auto Dismantling Company.
  • Call store, internet cafe or game center.
  • Coffee shop.
  • Erotic massage parlor.
  • Catering establishment within the meaning of article 2:15 APV.
  • Hair salon.
  • Sex establishment within the meaning of article 3:4 APV.
  • Smart, head or grow shop.
  • Amusement arcade within the meaning of Article 2:25 APV.
  • Wellness company.
  • Housing for migrant workers.
  • Tanning studio.

Rejection of application

Does the investigation reveal that the applicant is suspected of criminal activity or financing with money obtained from crime? Then the permit will be refused or revoked. The municipality may also impose additional conditions for granting a permit.

Decisions of the facts of the past 5 years:

  • if you are convicted
  • If you have entered into a settlement with the prosecution
  • If you have been identified as a suspect
  • If you have received an administrative or tax fine

+ Upon denial of a permit (if applicable)

Decisions of the facts of the past 5 years:

  • If a license for your business has been denied or revoked
  • If your business has been closed by order of the mayor

+ Data on financing 

  • opening balance sheet, investment and financing budget (for a new company)
  • income data for the last 3 three years (annual documents for business owners and annual statements in other cases)
  • last paycheck or benefit statement (if applicable)
  • supporting documents showing the amount and source of equity (account statements, etc.)
  • A copy of the financial agreement per financier/financing
  • per debt situation a debt agreement
  • Evidence showing the (amount of the) debt (bills, assessments, etc.)

How long will it take?

The Bibob investigation takes place within the standard period applicable to a permit application (this differs for each permit). If the municipality decides to request a recommendation from the Landelijk Bureau Bibob (LBB), the decision period is extended by 8 to a maximum of 12 weeks.

Objecting

Do you disagree with the decision? Then you can object within 6 weeks.
